Planning compliance

Planning compliance can be needed where land use or development is not in accordance with requirements of the Hepburn Planning Scheme.

This can happen in different ways.  If a planning permit should have been obtained, but was not applied for, compliance can be undertaken.  But also, if a planning permit has been obtained and the conditions have not been met, compliance may also be needed. 

Planning compliance involves:

  • Council receiving a report of, or observing, a suspected breach
  • Council’s planning compliance officer investigating the breach and inspecting the site if needed
  • The planning compliance officer undertaking enforcement actions as needed including issuing planning infringement notices, enforcement orders and magistrate’s court prosecution. 

Council relies on the community to assist us with upholding the planning scheme requirements.  We encourage residents to report suspected breaches to us and we can protect your privacy through that process.
